Annual Public Notice Requirements of 30 TAC §290.122 (c)
Monitoring and Reporting Violations
Violation Report Form
1. Notify TCEQ Violation Report Form
2. Submit to TCEQ copies of all notifications within ten days of
distribution
3. Initial public notice:
- Within 3 months; Mandatory health effects language is not
required, however, example language is provided.
- Community systems:
- Publish the notice in a daily
newspaper; or If a daily newspaper is not available to all
customers, publish the notice in a weekly newspaper; or If a weekly
newspaper is not available to all customers, notify customers by
direct delivery or by continuously posting in conspicuous
places.
- Noncommunity systems:
- Notify by direct delivery; or
Continuously post the notice in conspicuous places for as long as
the violation exists or at least 7 days.
4. Additional notice:
- Mandatory health effects language is not required.
- Community systems:
- Issue repeat notices every 12 months
by mail delivery or by hand delivery for as long as the violation
exists. May be included in the Consumer Confidence Report
- Noncommunity systems:
- If the initial notice was by
continuously posting, it must be posted as long as the violation
exists or at least 7 days; If the initial notice was by direct
delivery, notice by direct delivery must be repeated at least every
three months for as long as the violation exists.
5. When the violation is corrected, notification must be issued
in the same manner as the original notice was issued.
