Projects that affect small areas of waters of the
United States
and
that are for specific activities may qualify for a Nationwide
Permits (NWP). The 401 water quality certification for NWP has been
completed. However, a separate 401 water quality letter is equired
for projects included under a NWP 16 "Return Water From Upland
Contained Disposal Areas." Listed below are the TCEQ NWP 16 letter
requirements.

Project description with Corps permit number is required.

Project location, including the county, with vicinity map of the
project area is required.

Applicant must agree to a limit of 300 mg/l of total suspended
solids in the return water from the dredge disposal site.

Letter must be signed and dated by the applicant.

The signed agreement letter may be faxed to begin the approval
process but the original signed agreement letter needs to be mailed
to the TCEQ.
