Renewed Construction Storm Water General Permit TXR150000: What to Do

Key Dates:

  • TCEQ approved the permit February 13, 2008.

  • The permit will take effect March 5, 2008.

  • Existing permittees need to renew by June 3, 2008.

  • The permit is good through March 5, 2013.

Important Changes:

  • No annual billing of Water Quality Fee.

  • New application fees must be paid to obtain a new permit and to renew an existing permit:

    • $325 for paper Notice of Intent (NOI). If you sign and submit the NOI on paper, it is a “paper NOI.”

    • $225 for online ePermits NOI. The NOI must be completed, signed, and submitted online to qualify.

  • New dates of provisional coverage also depend on how you submit the NOI:

    • Starts 7 days later, if by paper

    • Starts immediately, if online

  • Change in the definition of “construction site operator.” Read the renewed general permit for details.

  • Changes to Storm Water Pollution Prevention Plan (SWP3) requirements. Read the renewed general permit for details.

Here’s What You Do:

If You Have an Existing Permit

If you need coverage after June 3, 2008, you will need to submit an NOI renewing your existing active permit(s) under the renewed general permit between March 5, 2008, and June 3, 2008. The full application fee will be required. You can renew on or after March 5 by using the ePermits online application or by submitting a paper NOI. (This paper form will not be available until March 5.) To get started renewing your permit(s) you will need to:

  • Use your existing permit number(s).

  • Confirm your Customer (CN) and Regulated Entity (RE) information in TCEQ’s Central Registry (CR) is current.  Search CR now to find out.

  • Update your Storm Water Pollution Prevention Plan (SWP3). This must be updated prior to submitting a NOI under the renewed general permit.

Apply to renew as early as possible. DO NOT risk the ability to renew online by waiting until the last few days.

If you DO NOT need coverage after June 3, 2008, you may opt to allow your permit to expire on June 3, 2008. All existing permits active and not renewed on June 3, 2008, will be considered expired on that date. Submission of a Notice of Termination (NOT) is not necessary. Note: The permit may continue to show an active status until all renewals submitted up to June 3, 2008, have been processed.

If You Need a New Permit on or after March 5, 2008:

  • If applying online (ePermits online application), the NOI for new and renewed coverage under the general permit will be available March 5, 2008.

  • If applying by paper NOI, you will need to use the new Notice of Intent form for new and renewed coverage under the new general permit. The form will be available on the Web beginning March 5, 2008. The TCEQ will not accept old forms on or after March 5.

If You Need to Terminate an Existing Permit:

  • Existing Permits that are not needed after June 3, 2008, will not need to submit an NOT. The existing permit will expire on June 3, 2008. NOTE that the status will still show ACTIVE in Central Registry until we have processed all paper NOI renewals, so that we will know what permits were not renewed. This does not relieve the operator of any unpaid fees assessed in the past.

  • A Notice of Termination is required if you filed an NOI after March 5. Go to ePermits online application or fill out a paper Notice of Termination form and mail it to the address in the instructions. A letter confirming termination will be mailed after it is processed.

Note: A Notice of Change is not available in ePermits at this time. For now, use the paper Notice of Change (form TCEQ-20391). For all other applications, follow these steps:

  1. Get a STEERS electronic reporting account

  2. Go to STEERS login page (ePermits online application)

  3. Log in and select the ePermitting program area: “ Storm Water General Permits (EPR_SW)”

  4. Select the “I want to Create an application” button and then:

    • To renew a permit: Select application type: “Apply to renew an existing CNOI Authorization” under the Construction General Permit. Enter the permit number being renewed. Read the permit information displayed to ensure that it is the correct permit and select the confirm button. Finish filling out each page, clicking the NEXT button to save your work and move to the next page.

    • To get a new permit: Select application type: “Create a new CNOI application for Notice of Intent.” Complete each section of the application in the order listed on the left side of window, clicking the NEXT button to save your work and move to the next page.

    • To terminate a permit: Select application type: “Terminate an existing CNOI authorization.” Enter the Permit number. Confirm you are terminating the correct permit. Select the reason.

  5. To complete your application (renewal, new permit, terminations): Return to the “Activities” page and select your permit application(s) that need to be edited, or that you want to view, or applications that are ready to sign, pay, or submit, or to add another persons account for access to the application. Finally, print and save all of the following information:

    • the application submitted to us (referred to as a Copy of Record (COR)),

    • the acknowledgment certificate, and

    • the cover letter.
