Applications with land application of Class B Sludge
Regardless of what type of application is being submitted, if a
domestic wastewater permit authorizes the permittee to land apply
Class B sewage sludge on their own property, and the applicant
completes the sewage sludge technical report,
-
THEN the applicant must provide an adjacent landowner map which
identifies all landowners within a quarter-mile distance from the
boundaries of the sludge land application site,
-
AND an additional sludge application fee (determined by
application of dry tons/acre/year) must be submitted along with the
water quality permit application fee.
Applicant Information
-
For All Permits, the owner of the facility must be the name
shown on the permit.

Item 1.a. on Page 2 of the Administrative Report, the correct
mailing address for the applicant should be provided, as well as
the Secretary of State filing number for partnerships and the
charter and tax identification numbers for corporations.

We verify the mailing address with the U.S. Postal
Service
.
Please provide the correct mailing address as shown with the U.S.
Postal Service. This is the address which will appear on the
permit.

Charter numbers are verified with the Texas Secretary of
State
. We
also verify that the applicant's name is correct and that the
partnership or corporation is currently existing and authorized to
conduct business in the State of Texas.

Tax identification numbers are verified with the Texas State
Comptroller
. We
also verify that the applicant is in good standing with the Texas
State Comptroller.
Signature Pages
Who can sign the application?
-
Municipalities or other government entities: Only a ranking
elected official or principal executive officer. Signatory
authority may not be delegated to anyone else.

Corporation: A principal executive officer of at least the level
of vice president.
-
Partnerships: A general partner as identified in the partnership
agreement or a principal executive officer of at least the level of
vice president.

Independent School Districts: At least the level of Assistant
Superintendent
-
State, federal, or other public facility: A principal executive
officer
-
Municipal Utility Districts: A principal executive officer or
board member
-
Sole proprietorships: The proprietor
-
Individual: Only the individual
Co-permittees must also submit a signature page.
Please use blue ink when signing signature pages. It is easier
to verify that the signature page contains the original
signature.
USGS Topographic Maps - For all applications
the following is required:

Full-sized, original, colored, 7.5-minute USGS topographic
maps
-
Coordinates around the map
-
Applicant's property boundaries delineated on the map
-
Location of the facility within the applicant's property
boundaries
-
Location of effluent disposal areas
-
Location of the point(s) of discharge (or outfalls)
-
The discharge route highlighted for three stream miles
downstream from the point of discharge (Because it is important
that the highlight not cover the map, use a light-colored
highlighter to show the discharge route. During technical review,
the stream characteristics shown on the map need to be clearly
identified.)

TPDES vs. TLAP
When filling out the Administrative Report of a new application,
you must check a box to indicate whether the permit is "TPDES" or
"TLAP." Here is how to make that determination:

Texas Pollutant Discharge Elimination System (TPDES) Permits -
effluent is discharged through an outfall, or point of discharge,
to a waterway, or waters of the state.
-
Texas Land Application Permit (TLAP) - effluent is disposed via
evaporation, irrigation, subsurface disposal, etc.
Note: Some TPDES permits include provisions for
the permittee to use a portion of treated effluent for
irrigation.
Permit Renewals
TPDES Permits
TPDES Permits Which Also Authorize Land Application of
Effluent - Items 5.b. through e. on pages 5 and 6 of
Administrative Report

If your permit is a TPDES Permit, and you are also authorized to
dispose of some effluent via irrigation or other type of land
application, you will need to address all items related to
TLAPs.
-
This includes describing the routing of effluent from the
facility to the disposal site and identifying the nearest
watercourse to the disposal site.
Supplemental Permit Information Form (SPIF) -
Only applications for TPDES (discharge) Permits need to have a
completed SPIF.
-
Although it is included as part of the Administrative Report,
the SPIF is a separate document from the application. The TCEQ must
send copies of the SPIF and any attachments to other state and
federal agencies, as required by agreement between the TCEQ and the
U.S. Environmental Protection Agency (EPA).

Attachments to the SPIF must be submitted separately from the
attachments to the application itself. If the same document is
going to be used for the application and the SPIF, you must provide
a copy for the application and one for the SPIF.
Brief Technical Report Reviews for Permit Renewals for
Minor Facilities
Domestic minor facilities have a flow of less than 1,000,000
gallons per day in their final phase; all industrial facilities
have the same review.

If renewing a permit, the application should include the same
flow amounts and acreage for effluent disposal authorized in the
current permit.

For domestic permit applications, effluent analysis should be
provided for all parameters shown on page 2 of the technical
report, regardless of what the current permit requires for effluent
analysis.

For domestic permit applications, if your facility is publicly
owned or both publicly and privately owned, you must provide
complete responses to all applicable items of Worksheet
6.0-Industrial Waste Contribution of the technical report.

For all TPDES permit applications, complete Worksheet
2.0-Receiving Waters for domestic facilities and Worksheet 4.0 for
industrial facilities.

For domestic and industrial TPDES permit applications with some
effluent disposal authorized in the permit, complete Worksheets 2.0
and 3.0 for domestic facilities, and Worksheet 3.0 and 4.0 for
industrial facilities.
TLAP Permits
Brief Technical Report Reviews for Permit
Renewals
- If renewing a permit, the application should include the same
acreage for effluent disposal authorized in the current
permit.
- For domestic permit applications, effluent analysis should be
provided for all parameters shown on page 2 of the technical
report, regardless of what the current permit requires for effluent
analysis.
- For domestic permit applications, if your facility is publicly

Major Amendment Applications
- On Page 2 of the Administrative Report, include a detailed
description of the major amendment being requested.
- Item 5.k. on page 6 of the Administrative Report - For TPDES
Permits, if effluent is to be discharged to a city, county, or
state highway right-of-way, or a flood control district drainage
ditch, you must provide copies of letters from the applicant to the
authority requesting authorization to discharge to the right-of-way
or ditch.

Items 5.a. through f. on pages 5 and 6 of the Administrative
Report - Provide all applicable information. Because there is not a
current permit for the proposed facility, we do not have location
information. Provide a location description which includes
directions and distances in feet or miles from road intersections.
Do not provide driving directions to the facility. Also, provide a
description of the effluent discharge route, from the point of
discharge to the nearest major watercourse (a classified segment as
defined in 30 TAC Chapter 307).

Permits, if effluent is to be discharged to a city, county, or
state highway right-of-way, or a flood control district drainage
ditch, you must provide copies of letters from the applicant to the
authority requesting authorization to discharge to the right-of-way

Property Boundaries

Only need to delineate applicant's property boundaries, property
boundaries of landowners located adjacent to the applicant's
property boundaries, and property boundaries of landowners located
adjacent to the discharge route.

For domestic wastewater permits, show the buffer zone around the
wastewater treatment units. All landowners located within the
buffer zone must be identified.
TPDES Permits - Point Of Discharge Or
Outfalls

Clearly label the point(s) of discharge or outfalls.

Provide a scale so it is evident that landowners located
adjacent to the discharge route for one full mile downstream from
the point of discharge have been identified.
-
Highlight the discharge route for one full mile downstream from
the point of discharge.
TLAP - Effluent Disposal Areas
All landowners located adjacent to the land where the effluent
disposal area is located need to be identified.
Identifying Adjacent Landowners
All landowners identified on the map should be identified with a
separate, consecutive number. Do not use lot, block, or tract
numbers.
