Public Notices for Municipal Solid Waste Applications

Notice of Receipt of Application and Intent to Obtain Permit

A notice indicating receipt of an application and intent to obtain a permit will be prepared and issued by the TCEQ in accordance with 30 TAC §39.418 and 30 TAC §39.501(c) for applications for new or amended municipal solid waste permits. The applicant must publish this notice.

Notice of Application and Preliminary Decision

A notice of application and preliminary decision will be prepared and issued by the TCEQ in accordance with 30 TAC §39.419 and 30 TAC §39.501(d) for permit applications that have been declared technically complete and filed with the TCEQ Office of the Chief Clerk. The applicant must publish this notice.

Requirement for Newspaper Notices in an Alternative Language

The TCEQ adopted amendments to 30 TAC Chapter 39, Public Notice, requiring newspaper notice in an alternative language for certain applications. Municipal solid waste permit and registration applications filed on or after November 30, 2005, are subject to the alternative language notice newspaper publication requirements.

A checklist for determining whether the alternative language notice requirement applies to a particular municipal solid waste permit or registration application is included in the Part I application form for a permit or registration.

A separate Public Notice Verification Form must also be completed and submitted to the TCEQ Office of the Chief Clerk along with the affidavit and other documents for each public notice.

Contested Case Hearing

If an application is referred to the State Office of Administrative Hearings for a contested case hearing under 30 TAC, Chapter 80, a notice of the hearing will be prepared and issued by the TCEQ. The applicant must publish this notice accordance with 30 TAC §39.501(f).
