Annual registration fees can be paid in full or paid using the
installment plan.
Effective September 1, 2006, the TCEQ will no longer issue,
amend, or renew permits, registrations, certifications, or licenses
to an entity or person who is delinquent on penalties or
fees.
Dry Cleaner Property Owners and Previous Dry Cleaner Property
Owners
To be eligible for
fund benefits, a property owner or previous property owner is
required to register with the TCEQ and pay an annual registration
fee of $1,500.
To avoid late fees, Dry Cleaner Property Owner or Previous Dry
Cleaner Property Owner registration is required by December 31,
2007. Late fees will be assessed at the rate of $100 per month
beginning Januay 1, 2008, until registration occurs.
The Dry Cleaner Property Owner and Previous Dry Cleaner Property
Owner fees will be billed on a quarterly basis, at $375 per
quarter. If the registration is received prior to the first billing
in late-September, the first bill will be $375. Registrations
received between mid-September and December 31, 2007, will be
billed for two quarters ($750). Registrations received after
December 31, 2007, will be billed for all past quarters and
(partial quarters) since September 2007, and assessed the
above-referenced late fee.
Dry Cleaner Property Owner and Previous Dry Cleaner Property
Owner registration fees must continue to be paid while any
corrective action under the fund is ongoing. If a property owner or
previous property owner fails to pay registration fees while
corrective action is ongoing, a lien can be placed on the property
for the costs of the corrective action plus the amount of unpaid
fees that accrue during the period of the corrective action.
After corrective action has been completed using fund money, the
use of perchloroethylene is prohibited at that site.
Previous property owners do not need to register if they do not
intend to receive fund benefits.
Dry Cleaner Solvent Fees
State law requires that solvent distributors
collect a fee on the purchase of dry cleaning solvents at certain
facilities with the exception of carbon dioxide
(CO2).
The solvent fees are $20 per gallon for perchloroethylene
("perc") and $3 per gallon for other solvents.
