State Incentives
Commission staff presented incentives received during the public
comment period when the EMS program underwent rulemaking by the
TCEQ commissioners at their August 2002 work session.

removed from consideration for several reasons, including:
- they are less protective of the environment and are
inconsistent with the intent of the legislation or related
legislation under the Sunset Bill;
- they conflict with an existing statute or a commission
initiative;
- they present too many logistical problems to be
implemented;
- the incentive already exists for all facilities in Texas;
or
- the commission does not have authority over the suggested
incentive.
