EMS: Archive of Incentives Previously Reviewed by the TCEQ

The following is historical information regarding incentives for the TCEQ’s environmental management systems (EMS) program. Most of these links go to documents in Portable Document Format (PDF). (Help with PDF.)

State Incentives

Commission staff presented incentives received during the public comment period when the EMS program underwent rulemaking by the TCEQ commissioners at their August 2002 work session.

  • Memorandum to Commissioners for Work Session (PDF)—describes proposed incentives.

  • Attachments to the memorandum:
    • Attachment A (PDF)—incentives that are consistent with the intent of the EMS legislation.

    • Attachment B (PDF)—incentives that the agency removed from consideration for several reasons, including:

      • they are less protective of the environment and are inconsistent with the intent of the legislation or related legislation under the Sunset Bill;
      • they conflict with an existing statute or a commission initiative;
      • they present too many logistical problems to be implemented;
      • the incentive already exists for all facilities in Texas; or
      • the commission does not have authority over the suggested incentive.
    • Attachment C (PDF)—incentives that will require a case-by-case evaluation; generally these were too broad or vague.
